What qualifications must a Hong Kong data company use to dispose of used hard drives? What are the risks of incomplete qualifications?

Used hard drives, server storage media, and other electronic devices generated during the operation of Hong Kong data companies often contain sensitive information such as core business secrets and customer personal data. Their disposal must meet both environmental compliance and data security legal requirements. This article, based on the Waste Disposal Ordinance (Chapter 354), the Personal Data (Privacy) Ordinance (Chapter 486), and related regulations, clarifies the essential qualifications for used hard drive disposal service providers and the legal risks of incomplete qualifications.

I. Essential Legal Qualifications for Used Hard Drive Disposal Companies

(I) Core Environmental Qualification: Hong Kong Environmental Protection Department Electrical Waste Disposal License

According to Sections 16 and 21-23 of the Waste Disposal Ordinance, since December 31, 2018, Hong Kong landfills and waste transfer stations no longer accept any electrical waste. Anyone storing, processing, dismantling, or recycling electrical waste, including computer hard drives, must hold an Electrical Waste Disposal License (e-WDL) issued by the Hong Kong Environmental Protection Department (EPD).

This license imposes strict requirements on the company's facilities, processing technology, environmental standards, and recycling rate:

• A detailed operation plan must be submitted, specifying the specific procedures for dismantling, crushing, and material sorting.

• The target material recycling rate must reach at least 80%.

• Operations must comply with all standards of the Air Pollution Control Ordinance, Water Pollution Control Ordinance, and Noise Control Ordinance.

• Any spills generated must not endanger public health or pollute the environment.

(II) Data Security Related Qualifications and Certifications

In addition to the statutory environmental license, to meet the data security requirements of the Personal Data (Privacy) Ordinance, destruction companies must also possess the following data security capability certifications:

1. ISO 27001 Information Security Management System Certification: Demonstrates that the company has established a sound information security management system capable of effectively protecting customer data during the destruction process.

2. Compliance with International Data Destruction Standards: Employs data destruction methods that comply with internationally recognized standards such as NIST SP 800-88, including physical destruction (shredding, drilling, demagnetization) and data overwriting.

3. Full-process traceability capability: Capable of video recording and numbered tracking of the entire process of hard drive disposal, from receipt, transportation, and destruction to final disposal, with records retained for at least 3 years.

(III) Other essential conditions

• Holding a valid Hong Kong Business Registration Certificate

• Possessing professional transport vehicles and personnel capable of safely transporting electronic waste

• Able to issue legally valid destruction certificates as proof of compliant disposal by the enterprise

II. Main risks of destroying waste hard drives without complete qualifications

(I) Serious legal penalties

1. Environmental violation penalties: According to the Waste Disposal Ordinance, anyone who disposes of electrical waste without a valid license is subject to a fine of HK$200,000 and imprisonment for 6 months on first conviction; a repeat offender may be fined HK$500,000 and imprisoned for 12 months.

2. Data protection violation penalties: If improper destruction leads to the leakage of personal data, violating Section 26 of the Personal Data (Privacy) Ordinance and Principle 4 of the Data Protection Ordinance, the data company, as the data user, will be subject to a maximum fine of HK$100,000; in serious cases, the Office of the Privacy Commissioner for Personal Data may issue an enforcement notice ordering rectification within a specified period.

3. Cross-border Legal Risks: Illegally transferring used hard drives to areas outside Hong Kong for disposal violates the Basel Convention and the Waste Disposal Regulations's regulations on the import and export of electronic waste, leading to more severe legal sanctions.

(II) Irreversible Data Leakage Risks

Unqualified disposal companies typically lack professional data destruction equipment and technology. Simply deleting files or formatting hard drives is insufficient to completely erase data. Industry data shows that over 70% of used hard drives can have their original data recovered using professional techniques.

For data companies, data leaks may result in:

• Theft of customer personal information, trade secrets, and intellectual property

• Facing large-scale customer complaints and class-action lawsuits

• Severe damage to brand reputation and customer loss

• Investigation and business restrictions by regulatory authorities

(III) Environmental and Social Responsibility Risks

Illegally disposed of used hard drives contain toxic and hazardous substances such as lead, mercury, and cadmium.
